SUBSCRIBER AGREEMENT
 
When you subscribe to The Dow Theory Barometer (hereafter "DTB") service you agree to the subscriber's Terms of Use as outlined below.
  • Term: This agreement starts with the commencement of your subscription to the Service, trial or paid, for the period you chose during the subscription process.

  • License: In consideration of your subscription fee, DTB grants to you a limited, non-exclusive, non-transferable license to use the content (the "Content") contained in the Service in accordance with the terms and conditions set forth in this Agreement.

  • Limitations of Use: You may not disclose, furnish or sell any of the content of the Service to any third party. You may not give your access password to any third party, allowing them access to the Services of DTB. It is a violation of federal copyright law to reproduce or distribute all or part of our Service or its contents by any means. Basically, you get to read, download, and print yourself a copy of the Weekend Barometer, and as far as we're concerned, you can share it with your spouse, kids, maid, chauffer, dog, cat and goldfish, as long as they all live with you. However, you can't give out your password to our site, and you can't print off a couple of extra copies every week to give to friends and associates. If you want to split the cost with one friend, go ahead that's cool, but tell us you are going to do that first. We're a friendly bunch. Otherwise, you are making it hard for us to make a living and thus, you expose yourself to the following: The Copyright Act imposes liability of up to $150,000 per issue for such infringement. Financial advisors or investment professionals who wish to use the advice for their clients' portfolios should inquire about a site license or multiple subscription discounts.

  • Intellectual Property: You acknowledge that all proprietary rights in the Content of the Service are and shall remain the property of DTB and that you have no right or interest in the content other than the right to use it in accordance with the terms and conditions contained in the Agreement for your own personal use.

  • Payment: You agree to pay all fees and charges incurred in connection with your account at the rates in effect when the charges occur. You have 30 days from the date to notify us of any discrepancies in your credit card statement in relation to your subscription; after that time, all charges will be deemed correct. You agree to pay all amounts due upon our demand in accordance with you subscription. In the event we have to collect unpaid amounts you owe us, you will be liable for all attorneys' and collection fees.

  • Cancellation: Requires written notice within the first 30 days of your first subscription or you may e-mail your cancellation to info@dowtheoryproject.com. However, you must receive a confirmation from us affirming your cancellation. Here's the deal: The first time you subscribe, you deserve the opportunity to make sure you enjoy our product, so we'll give you 30 days to decide. By keeping your subscription, you are saying, "I like the Weekend Barometer", and from that point on, including subsequent renewals, there are no refunds of any kind.

  • Compliance with applicable Law: You will comply with all applicable laws and regulations relating to use of the Service including federal copyright laws. Again, the dog, the cat, the maid, blah blah blah.

  • Limitations of Liability: DTB is a publisher of investment-related publications. The service is intended as a guide and an educational vehicle. It is not registered with any state securities authority or the U.S. Securities and Exchange Commission as it does not provide any "personalized" investment advice. The Service is not an offer to sell any securities, mutual funds, or investments of any type. You should not rely solely upon the content of the Service for your investments, but should always do your own research and due diligence on any investment you engage in. The opinions expressed in the Service are those of the authors. DTB does not guarantee any level of investment profits should the analysis be followed by you, nor the accuracy, completeness, or suitability of the investments discussed. Investments in securities have inherent risk, and you assume all risk associated with the investment process. DTB will not be liable for any monetary loss resulting directly or indirectly from use of the Service. DTB makes no warranty of any kind, express or implied, including, without limitation, any warranties of fitness for a particular purpose.

  • Indemnity: You shall indemnify TWB from and against all claims, costs, demands, expenses and liabilities, including reasonable attorney's fees, resulting from your breach of this Agreement.

  • Severability: If any part of this Agreement is held invalid, illegal or unenforceable, the remaining provisions will be unimpaired.
